In recent days, the name Malam Nasir Ahmad El-Rufai, former governor of Kaduna State and a prominent political figure in Nigeria, has dominated national conversations not for policy or public service, but because he is now at the centre of a multifaceted legal and political controversy involving the federal government, anti-graft agencies and national security institutions. This situation reflects broader questions about governance, accountability, the justice system, and the space for political dissent in Nigeria.

The current drama did not begin overnight. El-Rufai, who served as Governor of Kaduna State from 2015 to 2023, first entered the public eye as an outspoken technocrat, a reformer with a reputation for bold decisions on infrastructure, education and urban policy. Over time, he became a key ally of President Bola Ahmed Tinubu during the 2023 presidential campaign, only for their paths to diverge sharply later, especially after El-Rufai’s ministerial prospects did not materialise and he joined the opposition African Democratic Congress to challenge the government’s direction.

Earlier this month, El-Rufai voluntarily presented himself at the headquarters of the Economic and Financial Crimes Commission (EFCC) in Abuja following an invitation linked to alleged financial improprieties from his time as governor. These allegations reportedly stem from concerns raised by the Kaduna State House of Assembly about missing funds and possible diversion of billions of naira of public money, claims that have been under scrutiny for some time.

At the EFCC, officials questioned him for hours under suspicion of involvement in financial misconduct said to be associated with contracts, government loans and project spending during his tenure. One widely reported figure in the media though still under examination in official filings mentions an alleged probe into around N432 billion in transactions, though El-Rufai and his defenders insist that all loans and funds were properly appropriated and used for infrastructure, education, healthcare and security.

What began as a single enquiry soon expanded. After about two nights at the EFCC complex, and after being granted administrative bail, El-Rufai was immediately picked up by operatives of the Department of State Services (DSS), not for the same financial questions, but in connection with another serious matter. Authorities allege that in a public television interview, El-Rufai said he became aware of a plan to arrest him based on a conversation he claimed to have heard through the phone communications of the Office of the National Security Adviser, an allegation that led to the filing of three separate counts of criminal charges at the Federal High Court in Abuja. Instead of calming after these developments, the situation intensified. The Independent Corrupt Practices and Other Related Offences Commission (ICPC) has now confirmed that El-Rufai remains in custody as part of ongoing investigations connected to both the financial and security allegations.

Amid these legal proceedings, public reactions have spanned the spectrum. There have been protests outside the EFCC headquarters, with some demanding swift prosecution and others decrying what they see as selective targeting of political opponents. Some advocacy groups have called for thorough investigations into all public officials, insisting that no one should be above the law.

Supporters of El-Rufai argue that parts of the probe are politically motivated, a way to weaken critics of the current administration and disrupt opposition coalitions ahead of future elections. They point to his strained relationship with the federal government, especially after falling out with President Tinubu’s circle, as evidence that politics may be shaping the intensity of the legal response.

Critics within civil society, on the other hand, insist that corruption and breaches of national security protocols need to be investigated fully, transparently and without political interference. They urge that those accused be given a fair chance to defend themselves in court not only to protect individual rights, but to uphold public confidence in Nigeria’s justice system.

His defenders see a seasoned leader fighting what they call politically tinged prosecutions; his detractors see a former governor finally being held to account. The federal government, through its agencies, maintains that these actions are based on allegations backed by evidence that must be independently tested in court, a process that, ideally, respects due process and the constitutional rights of every citizen.
