Justice Joyce Abdulmalik of the Federal High Court in Abuja has ordered the return of former Attorney General of the Federation and Minister of Justice, Abubakar Malami, SAN, along with his wife and son, to prison on remand following their re-arraignment by the Economic and Financial Crimes Commission, EFCC, on corruption charges.

The judge directed that Malami and his son, Abubakar Abdulazeez Malami, be taken to Kuje prison in Abuja, while his wife, Asabe, is to be remanded at Suleja prison in Niger State.

Justice Abdulmalik gave the order on Friday, the 27th of February, 2026, after taking the plea of the three defendants in the N8.7 billion corruption case.

Malami’s counsel, Joseph Daudu, SAN, reminded the court of the January 7 bail granted by Justice Emeka Nwite of the same court and perfected by Malami.

He urged that the court adopt the same bail conditions, arguing that the Federal High Court is one in Nigeria and that applying the previous terms would serve the interest of justice.

The EFCC'S counsel, Jibrin Okutepa, SAN, confirmed the prior grant and perfection of bail conditions.

Despite this, Justice Abdulmalik ruled that the proceedings before Justice Emeka Nwite had been legally concluded and that new bail applications must be submitted.

Daudu’s attempt to move oral bail applications was rejected.

Justice Abdulmalik scheduled the 6th of March for arguments on the bail applications and trial.

Recall that on the 7th of January, Justice Emeka Nwite of the Federal High Court in Abuja had granted Malami, his wife, and son bail of ₦500 million each, with strict conditions including submission of landed property documents and travel papers.
